ORDINANCE NO. 539-11
AN ORDINANCE AMENDING Cathlamet MUNICIPAL CODE (CMC) TITLE 18 - ZONING: CHAPTER 18.20 - PROVIDING FOR LIMITATIONS ON TEMPORARY BUILDINGS WITHIN THE RESIDENTIAL ZONE IN THE TOWN OF Cathlamet; AMENDING CHAPTER 18.25 - PROVIDING FOR UTILITY CORRIDORS WITHIN COMMERCIAL AND COMMERCIAL/INDUSTRIAL ZONES IN THE TOWN; AMENDING CHAPTER 18.60 - BOARD OF ADJUSTMENT, PROVIDING FOR PERIODIC MODIFICATION OF FEES CHARGED AND FOR APPEALS OF DECISIONS OF THE BOARD OF ADJUSTMENT; AND PROVIDING FOR DEFINITIONS OF BARRIERS, HEDGES AND FENCES WITHIN EACH ZONING DISTRICT IN THE TOWN OF Cathlamet, WASHINGTON.
WHEREAS, the Town of Cathlamet (Town) has established zoning laws to provide orderly development, ensure public safety, establish and protect rights and values of property owners and bring reliability to the development of properties within the physical limits of the Town; and
WHEREAS, the Cathlamet Town Council, in consultation with and in consideration of the recommendations of the Town’s Planning Commission, has determined that the existing Cathlamet Municipal Code (CMC) Title 18, the Town's zoning law, would be improved with certain amendments clarifying language, redefining some terms and making the code more uniform and easier to apply and understand; and
WHEREAS, after diligent examination of its current ordinances and public hearing, the Town Council has found that the following sections of the zoning law would be improved by the amendments made herein:
Section 18.20.020 (Residential District) by adding a provision relating to temporary buildings; and
Section 18.25.040 (Commercial District) and Section 18.30.050 (Commercial/ Industrial District) by creating utility corridors within those two zoning districts; and
Chapter 18.60 (Board of Adjustment) by providing periodic modification of fees charged and for rules guiding the appeal of decisions made by the Board of Adjustment; and
By adding certain definitions and rules relating to barriers, hedges and fences.
This ordinance shall take effect and be in full force on five days after passage and publication.
