Michael Sullivan, judge

September 12, 2011

State versus Dana K. Montgomery, 31, Skamokawa: The defendant had been found guilty in a jury trial of a charge of criminal trespass. She was ordered to serve 20 days in jail and to pay a $500 Crime Victim Assessment (CVA), $874.06 court costs, $141.49 restitution, a $50 court security assessment, and the cost of her court appointed attorney.

State versus James T. Kissinger, 36, Clatskanie: The defendant was charged with second degree assault and malicious mischief; arraignment was set for September 26. The state charges that Kissinger was camping with a woman and attempted to attack her while she was in her vehicle by striking it with an ax.

State versus Nina M. Simonelli, 33: The defendant entered an Alford Plea, admitting no guilt but that the state had evidence that could convict her of the crime of possession of stolen property. The state charged that she was found driving an RV belonging to another person. She was sentenced to 15 days in jail and ordered to pay a $500 CVA, $1,520 cost of her court appointed attorney, $622 in restitution, and $230 in court costs.

State versus Kristy Marie Schroeder, 31, Salmon Creek: The defendant entered a not-guilty plea to a charge of possession of a stolen vehicle. The state charges that she was in control of a U-Haul van stolen in Oregon. A jury trial was scheduled for October 18.

State versus Lloyd E. Patten, 44, Salmon Creek: The state alleges that Patten was in possession of a U-Haul van stolen in Oregon. A Wahkiakum deputy sheriff contacted the van at the Rosburg Store; Patten and a woman were inside. He was taken into custody on a warrant of arrest from Linn County, Ore. The van was later found abandoned off Hungry Highway Road, and officers learned it was a stolen vehicle.

A juvenile male defendant pled guilty to a charge of child molestation in the first degree; a sentencing hearing was scheduled for November 21.

The court signed a decree of dissolution of marriage for Mary Jean Parker, petitioner, and Duane Glen Smith, respondent.
