NOTICE OF APPLICATION TO APPROPRIATE

PUBLIC WATERS

TAKE NOTICE:

That Public Utility District No. 1 of Pend Oreille County of Newport, WA on March 4, 2011, under Application No. S3-30635 filed for permit to appropriate public waters, subject to existing rights, from Sullivan Lake, tributary to Outlet Creek/Sullivan Creek in the amount of 225 cubic feet per second, each year, for Hydropower, Instream Flow, Mitigation for out of stream beneficial uses, and Mitigation of new reservoir operations, including recreation, aesthetics, and in-lake resident fisheries values. The source of the proposed appropriation is Sullivan Lake, located within the SW¼NE¼ of Section 31, Township 39 N., Range 44 E.W.M., in Pend Oreille County.

The proposed application for a secondary use permit is made pursuant to an agreement with Department of Ecology’s Office of Columbia River to change the timing of annual releases of water from Sullivan Lake. This appropriation will not increase the quantities of water currently impounded and diverted from Sullivan Lake. Notice is provided pursuant to RCW 90.42.040(5) that Ecology intends to issue a trust water right for a portion of the releases identified herein to be used for both instream flows, and as mitigation for the issuance of new permits.

Protests or objections to approval of this application must include a detailed statement of the basis for objections; protests must be accompanied by a fifty-($50.00) dollar recording fee and filed with the Department of Ecology, at the address shown below, within thirty (30) days from last date of publication: August 4, 2011.
