I.
NOTICE IS HEREBY GIVEN that the Sheriff of Wahkiakum County has been directed by the Superior Court of Wahkiakum County in the above-captioned action to sell that certain real property described herein. The Court has ordered a minimum opening bid of $67,700.00. Seller is entitled to payment from the sales proceeds in the following sums:
(a) Seller Koziel is entitled to $52,038.74 in
unpaid balance and late charges;
(b) unpaid real estate taxes for 2008, 2009 and 2010 in the amount of $3,190.84;
(c) delinquent utility payments to
Skamokawa Water & Sewer District in the amount of $8,843.63; and
(d) Attorneys' fees and costs incurred in
forfeiture and sale in the amount of
$3,556.65.
The total sum of debt and other lien obligations is $67,629.86.
II.
The real property to be sold, commonly known as "the Oasis Tavern," is located at 8 Fairgrounds Road, Skamokawa, Washington, and is legally described as follows:
Lots 1, 2, 3 and 4, in Block Three (3) of CENTRAL SKAMOKAWA, as per plat thereof recorded in Book "A" of Plats, page 15, records of Wahkiakum County, Washington; EXCEPTING THEREFROM the South and the West 10 feet thereof heretofore conveyed to Wahkiakum County by deed recorded in Volume 2 of Deeds, page 158, records of Wahkiakum County, Washington.
Situate in the County of Wahkiakum, State of Washington.
III.
1. The Conditional Sales Contract that is the subject of this forfeiture sale is dated March 13, 1991 and was recorded under Auditor's File No. 40674, in Book 84, Page 181, records of Wahkiakum County, Washington.
IV.
1. Said property shall be sold for cash to the highest bidder on the 27th day of December, 2010, at the hour of 11 o'clock a.m., at the front steps of the Wahkiakum County Courthouse, 64 Main Street, Cathlamet, Washington, and will be held by the Sheriff or his designee, without delay, in compliance with statutory notices and procedures.
2. The Court has ordered that the minimum Opening Bid at said public sale shall be $67,700.00.
V.
Said sale shall eliminate the interest of all persons given the Notice of Intent to Forfeit filed for record June 21, 2010, under Auditor's File No. 2016697, records of Wahkiakum County, Washington.
VI.
The Buyer may avoid this public sale ordered by the Court by paying to the Sheriff, at any date before the date of sale, in cash, the amount the seller would be entitled to be paid from the proceeds of the sale, as specified above.
VII.
Unless otherwise provided in the contract between the seller and buyer, or other agreement with the seller, no person shall have the right to redeem the property after the sale.
